Dancia Penn & Co.

The firm was established in 1984 by Dancia Penn, a former Attorney General of The British Virgin Islands. Dancia Penn & Co conducts an extensive international practice in areas ranging from corporate and commercial law through to litigation, from its offices in central Road Town. The day to day operations of the Firm involve regular dealings with most major commercial and financial centres throughout the world.
Each of the attorneys in the Firm places particular emphasis on practising in certain areas of law as specialisation is extremely important in legal practice today. The Firm does however remain sufficiently close knit as to enable close consultation and a high degree of interchange of information between individual attorneys. As communication and back-up staff and services are essential features of a modern international law practice, the Firm employs a full complement of qualified legal assistants, accounting, secretarial and other staff and has and will continue to make substantial investment in computing.

Corporate and Commercial
The Firm deals with all types of corporate and commercial work including advice on establishing different types of companies such as trust companies and mutual funds. Our clients take advantage of our wealth of expertise in numerous areas of commercial law including financing, liquidations, public and private offerings and bond and note issues.

We render advice relating to the formation, management and administration of companies including advice on both their operations and structure. Advice on international transactions involving International Business Companies (“IBCs”) is given on a daily basis, mainly to other law firms located all over the globe.

Trust Law
The Firm is regularly involved in the establishment and variation of trusts of all types for a wide variety of purposes including, but not limited to, tax and estate planning. We frequently advise both local and international trustees and trust companies and provide a full range of services in this field including advice on the setting up of trusts of all types.

Real Estate
The Firm represents many clients in private real estate transactions including the sale and purchase of both real property and businesses. In addition to these areas we are fully conversant with all other conveyancing matters and have dealings with the Land Registry on a daily basis.

Intellectual Property
The Firm regularly deals with all areas associated with the registration and licencing of patents and trademarks in the BVI. We can also handle applications for registration based upon applications made in the United Kingdom.

Ship Registration and Admiralty
The Firm provides service in all areas relating to admiralty and maritime law including, but not limited to ship registrations, arrest and releases. Many owners register their vessels in the BVI to take advantage of our relatively uncomplicated and cost effective ship registration procedures and may also take advantage of our confidentiality benefits by arranging for an IBC to own the vessel. The BVI is a British Port of registry and any vessel registered here has the right to fly the British flag and therefore enjoy the benefits which entail. Many UK registrations are applicable here through the Merchant Shipping regulations.

Litigation
The Firm is involved in and has wide experience in many aspects of civil litigation in the BVI whether arising from within the BVI or abroad, with a particular emphasis on commercial litigation. The Firm advises on litigation or potential litigation and is well qualified to deal with the urgent applications to Court which are often necessary such as Mareva injunctions and discovery orders. The wide range of commercial litigation undertaken includes corporate disputes of all kinds including shareholder disputes, liquidations, property disputes and trusts actions.

The Firm has particular expertise in the area of insolvency and maintains a close working relationship with specialist leading counsel in this area outside of the BVI.
